What is anti-trans legislation?

 

As of May 2021 there are 30 states with proposed laws that directly attack transgender youth and adults making it nearly impossible for them to access safe healthcare, safe public bathrooms, updated legal documentation, athletic participation and safe spaces in schools. The result of this legislative attack is not simply inconvenience, it is an exponentially increased suicide rate for trans people as well as a very loud and public national message that trans people should not exist and do not deserve legal protection. The moment a trans person steps out of their home, they are facing negative messaging. Now, more than ever, trans youth need protectors in their lives.

 

Bans on gender-affirming healthcare for minors.

These laws typically target doctors and healthcare providers and sometimes parents, making it illegal—often with associated criminal charges—to consent to or provide gender-affirming healthcare (including gender-affirming therapy and hormone replacement therapy) to trans youth. Some bills would revoke the medical licenses of doctors who agree to provide care for trans youth, including mental health services. In some cases where healthcare for trans youth would be classified as child abuse, kids could be removed from their parents and placed in state care.

Bills that restrict access to athletic programs based on sex assigned at birth. 

These bills seek to restrict sports participation based on sex assigned at birth, with the result being that trans and intersex youth would be forced to participate on the team associated with their sex at birth. Some states would require the inspection of internal and external sex organs in order to participate. One of the harshest proposed laws would charge children as young as 13 with a misdemeanor if found playing sports with other kids of their same gender.

“Bathroom bills” that limit access based on sex assigned at birth.

While the most prominent so-called “bathroom bill” was North Carolina’s HB2 in 2016, the bills have not gone away. Currently there are several that aim to block trans people and kids from using the restroom or locker room that corresponds to their gender identity and presentation. Most recently, Tennessee passed a bill requiring businesses and government facilities to post a sign if they let transgender people use multi-person bathrooms, locker rooms or changing rooms associated with their gender identity.
